DMCA Notice - Summitify Web-based Music App

Summit Tech World respects the intellectual property rights of others and expects users of the Summitify web-based music application ("Summitify" or the "App") to do the same. Pursuant to the Digital Millennium Copyright Act ("DMCA"), we have implemented the following notice and takedown procedure to address copyright infringement claims on Summitify.
1. Reporting Copyright Infringement
If you believe that your copyrighted work has been infringed upon on Summitify, please notify us by sending a written notification ("DMCA Notice") to our designated Copyright Agent. Your DMCA Notice must include the following information:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
- Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material.
- Information reasonably sufficient to contact you, such as your name, address, telephone number, and email address.
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

2. Counter-Notification
If you believe that your material was removed or access to it was disabled as a result of mistake or misidentification, you may submit a counter-notification ("Counter-Notice") to our Copyright Agent. Your Counter-Notice must include the following information:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access to it was disabled.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, telephone number, and email address.
- A statement that you consent to the jurisdiction of the federal court located within your jurisdiction and a statement that you will accept service of process from the person who provided the DMCA Notice or their agent.
Please send your Counter-Notice to our designated Copyright Agent.
3. Repeat Infringers
Summit Tech World reserves the right to terminate the accounts of repeat infringers. If a user's account is terminated for copyright infringement, they will be unable to create new accounts on Summitify.
4. Disclaimer
While Summit Tech World strives to promptly address copyright infringement claims, we are not responsible for verifying the accuracy of DMCA Notices or Counter-Notices. We may, in our discretion, remove allegedly infringing material or disable access to it, regardless of whether we determine that it is infringing or not.
